Terms of Service
Version 2026-10-27.1 · Effective October 27, 2026
- Every campaign is paid. You place flyers on paid teams as an independent contractor, not an employee, and each flyer pays at least Denver's minimum wage at a normal pace. Points have no cash value.
- Follow the law: never put flyers in mailboxes, respect "no soliciting" signs and private property, and don't litter.
- GETAWAY® is our registered trademark. Getaway LLC (Getaways Near Me) owns it, the Drops service, and the flyers. You can print and hand out flyers only for the campaign they belong to.
- You let us show your display name, notes, and drop activity in the app and in our promotion.
- We collect your email and the locations of drops you log, and use them to run Drops.
1. Agreeing to these terms
These Terms of Service ("Terms") are an agreement between you and Getaway LLC, a Florida limited liability company doing business as Getaways Near Me ("GNM," "we," "us") for Getaway Drops at drop.getawaysnearme.com (the "Service"). By checking the box when you join, or by using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
2. Who can join
You must be at least 18 years old to join. By joining you confirm you are 18 or older and able to agree to these Terms.
3. Your account
- One account per person. Your account is personal and can't be shared, sold, or transferred.
- Keep your 6-character sign-in code private. Anyone with it can sign in as you, and you're responsible for activity on your account.
- You can be signed in on one device at a time. Signing in somewhere new signs you out elsewhere.
- Pick a team member name that isn't offensive, misleading, or someone else's name or brand. We may change or remove names that break this rule.
4. Paid work only
Every campaign in the Service is paid for by an event host or a local business. Flyer drops count only on paid teams, so every flyer you place is paid under section 6a. There is no unpaid flyering.
Each spot on a team covers a set share of the campaign's flyer goal (the goal divided by the number of spots). Shares are sized so that, at our standard pace of 40 flyers an hour, the pay is at least Denver's minimum wage (currently $19.29 an hour). Once you've placed your share, the app stops logging drops for you on that campaign, so you never do flyer work that isn't paid. Your crew is welcome to apply for another campaign.
When you place flyers, you do so as an independent contractor, not as an employee, agent, or partner of GNM or any host or business. You're paid per flyer and per result, not by the hour, and you decide when, where within your zone, and how fast you work, and whether to apply for a campaign at all. You can't make promises or sign agreements on anyone's behalf.
If you have a separate written agreement to be paid for street team work, that agreement governs your pay and controls if it conflicts with these Terms.
5. Drop rules and conduct
Application and license. Before you can join a team or log drops, you apply as a canvasser (contact details, a resume link, where and when you can work) and hold a current peddler (solicitor or vendor) license from the state or city where you flyer. You give us the issuing state, your license number, expiry date and a photo of it, and you keep it current. Your name and license number are printed on the flyers you hand out. If your license lapses, is suspended, or is revoked, you stop canvassing and tell us right away. We may verify your license with the city and may approve or decline any application.
When you hand out or post flyers, you agree to:
- Carry your peddler license whenever you canvass and show it if a resident, business or officer asks.
- Never put flyers in or on mailboxes. Federal law only allows postage-paid mail there. Use door handles, screen doors, or community boards instead.
- Follow all local laws on posting, handbills, and soliciting, including rules against flyers on car windshields where they apply.
- Respect "No soliciting," "No trespassing," and "No flyers" signs, gated communities, and any request to leave.
- Ask before leaving flyers at a business, and only post on community boards where posting is allowed.
- Leave nothing loose to blow away, and pick up any flyer that falls.
- Be courteous. No harassment, threats, or arguing with residents or businesses.
- When you photograph a drop, photograph the flyer only. Keep people, faces, license plates, house numbers and the inside of homes or businesses out of the shot.
To keep the Service fair, you agree not to:
- Log drops you didn't make, inflate flyer counts, or fake or spoof your location.
- Reuse, edit, or borrow drop photos, or fake a photo's time or location.
- Use more than one account, bots, scripts, or any tool that automates drops.
- Generate fake QR scans or share-link clicks.
- Interfere with, probe, or overload the Service or other team members' accounts.
6. Points, leaderboards, and rewards
- Points, zones, badges, and leaderboard positions are for fun and recognition. They have no cash value and can't be sold, traded, or exchanged.
- Getaway co-hosts (event hosts who opt in on getawaysnearme.com) can also earn Summits from their points. Summits are governed by the Getaway co-host terms: they are non-transferable service credit for Getaway production services, can't be cashed out, and are not pay for work.
- We may adjust scoring rules, correct mistakes, and remove points earned by breaking these Terms.
- Any prize or reward is offered only under the specific rules announced for that campaign. If a reward has value, you're responsible for any taxes, and we may ask for information needed to deliver it.
- We decide disputes about points, rankings, and rewards, and those decisions are final.
6a. Paid campaigns and cash earnings
- Some campaigns are marked 💰 paid. An event host paid for them, and each one comes with a set team budget and a set number of team spots (for example 2, 4 or 8), worked in pairs. Campaigns are staffed by crews. A crew member can apply on the crew's behalf with the members who'll work it, and Getaway decides which crews and members to approve; approved members are given spots in pairs. A campaign becomes active, and drops start counting, only once its full team is staffed. Applying doesn't guarantee a spot, and you can withdraw a pending application at any time.
- Some paid campaigns are 🏷️ brand campaigns, bought by a local business. They work like other paid campaigns (spots, pairs, team budget, photos and the pay rules below), with three differences: drops count only from the campaign's start date through its 7th day; results are in-person scans and shared-link clicks only; and cash becomes available after the 7-day window ends. Place brand flyers only where section 5 allows, never in mailboxes, and don't make promises about a brand's offer beyond what the flyer says.
- After the event, the team budget pays out in proportion to the flyers the team placed against the campaign's flyer goal. Of that amount, 60% is split by flyers placed and 40% by verified results (in-person scans of your flyer QR code, clicks on your shared link, RSVPs and tickets), or by flyers placed if there are no results. Partners in a pair split their pair's total equally. Budgets are sized so an average pace earns about $25 an hour, but that is an estimate, not a guaranteed wage or hourly rate.
- Each paid team also has a bonus pot, paid by Getaway on top of the team budget, worth up to 7.5% of that budget. The pot is split among the team by bonus weight: your pay on the campaign times your level and weekly-streak bonus (each week in a row with at least one drop adds 5%, up to 25%), with results on shared flyers counting a little extra. If the team's combined bonus is smaller than the pot, each team member gets their full bonus and the rest isn't paid out. The pot size and weights can change for future campaigns. Performers on an event earn on paid teams exactly like everyone else, including results for their own event.
- Commission campaigns. On events Getaway runs itself, a campaign may pay by performance instead of a team budget: a set amount for every counted flyer you place (never less than the pay floor below), plus a stated percentage of the ticket sales your QR code or share link brings in, split 50/50 inside a pair. The rates are shown on the campaign before you apply. Ticket sales count once they're paid and not refunded, and the bonus pot is 7.5% of the campaign's total pay. Getaway pays all of it.
- Pay floor. Every flyer you place on a paid team that counts (not rejected in a photo check) pays at least Denver's minimum wage divided by 40 flyers an hour (currently $0.48 a flyer). If the split above would leave your base pay below that on a campaign, Getaway adds the difference on top of the team budget. Your bonus pot share is always paid on top of this floor, never counted toward it.
- If an event's host adds you as a performer, your performer link is for sharing online (flyer drops happen only on paid teams), and Getaway may also pay a performer reward for RSVPs your own links bring to that event (currently $1 per RSVP, up to $25 per event), and share-link clicks on your own event earn extra points. Performer rewards follow the same cash rules below and can change for future events.
- Cash becomes available only after the event has happened and after you've logged at least 10 drops. Payouts are sent through Stripe once you finish payout setup, with a $25 minimum. Rates can change for future campaigns; changes never reduce what you've already earned.
- When you earn cash, you do so as an independent contractor — not an employee — and you're responsible for your own taxes. Stripe collects any tax information needed and may issue tax forms; Getaway never asks for or stores your Social Security number or bank details.
- Paid teams require a photo of each drop. We check the photo's own time stamp and location against the drop you log, and look for reused photos. Only photo-verified drops earn: a drop without a photo never counts toward pay, and drops whose photo doesn't line up are held for review and count only if approved. Drop photos are stored to verify your work, shown to the event's host and Getaway, and never posted publicly.
- If we remove you from Drops, you're signed out and can't sign back in, but pay you've already earned under these Terms stays yours and is paid under the usual rules. We may hold, void, or reverse earnings tied to fake drops, fake scans or clicks, self-referrals, duplicate accounts, or anything else that breaks section 5, and we may recover payouts made because of them.
7. Intellectual property and content license
What GNM owns. GNM (or its licensors, including event hosts) owns the Service and everything in it: the software, design, scoring system, the GETAWAY® trademark and every name and logo that uses it (including Getaway Drops and Getaways Near Me), event names and artwork, flyer designs, QR codes, maps and zone data we create, and all related content ("GNM Materials"). These are protected by copyright, trademark, and other laws. Except for the limited license below, you get no rights in GNM Materials.
The GETAWAY® registered trademark. GETAWAY is a registered trademark of Getaway LLC, registered with the U.S. Patent and Trademark Office. You may not use "Getaway" or anything confusingly similar in a business name, social media handle, domain, event, product, or crew name, or in any way that suggests you speak for or are endorsed by GNM, except as part of the official flyers you hand out. Any goodwill from use of the mark belongs to Getaway LLC.
Your limited license to use flyers. While you're in good standing, GNM gives you a limited, personal, non-exclusive, non-transferable, revocable license to print and hand out the flyers and QR codes the Service provides, only to promote the campaign they belong to, and only as provided. You may not:
- edit, crop, recolor, or add to a flyer or QR code, or create your own flyers or merchandise using GNM or host names, logos, or artwork;
- use GNM Materials for any other event, business, cause, or personal purpose, or in a way that suggests GNM or a host endorses you or anything else;
- sell, sublicense, or distribute GNM Materials except by handing out flyers as part of a campaign;
- copy, reverse engineer, scrape, or build a competing product from the Service.
This license ends automatically when your account ends or when we ask you to stop.
Your content. "Your Content" means what you add to the Service: your display name, crew, drop notes, and any other text or media you submit. You keep any ownership you have in Your Content. You grant GNM and its partners a worldwide, royalty-free, non-exclusive, perpetual, irrevocable, sublicensable license to use, copy, store, display, modify (for example, to resize or shorten it), and distribute Your Content to run, improve, and promote the Service and GNM events. This includes showing your display name, crew, points, and badges on leaderboards and in GNM marketing. You confirm you have the right to share Your Content and that it doesn't break any law or anyone else's rights.
Drops data. Drop records, zone maps, scan and click counts, and the statistics built from them are a compilation owned by GNM. We may use them, including in aggregated form, to run campaigns, report to event hosts and partners, and plan future events.
Feedback. If you send us ideas or suggestions, we may use them freely without paying or crediting you.
Map data. Maps use OpenStreetMap data, © OpenStreetMap contributors, available under the Open Database License. Those rights belong to their owners, not GNM.
Reporting infringement. If you believe something in the Service infringes your rights, email us (section 15) with the details and we'll review it.
8. Privacy and location data
- What we collect: your email (to send your sign-in code and invites), your display name and crew, the drops you log (location, time, spot type, flyer count, and notes), and QR scans and share-link clicks credited to you.
- Location: your location is read only when you log a drop, to place it on the map and score zones. Drop locations are shown on the in-app map.
- How we use it: to run the Service, score points, prevent cheating, share campaign results with event hosts and partners, and contact you about the Service and GNM events. We don't sell your personal information.
- Email: sign-in codes are sent through our email provider. You can ask us to stop non-essential emails at any time.
- Your choices: you can ask us to update or delete your account and personal information by emailing us. Some anonymized Drops data may be kept.
9. Safety and assumption of risk
Handing out flyers means walking, biking, or driving in public places, near traffic, in all kinds of weather, and around strangers and animals. You choose where, when, and how you work, and you accept the risks that come with it. Stay aware of your surroundings, never use the app while driving, avoid unsafe areas, and stop if you feel unsafe. GNM does not supervise your activity.
10. Suspension and ending your account
You can stop using Drops at any time and ask us to delete your account. We may suspend or end any account, remove points, or block access if we believe you broke these Terms or the law, or to protect team members, hosts, residents, or GNM. We may also change, pause, or end the Service or any campaign at any time.
11. Disclaimers and limits of liability
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise the Service will be uninterrupted, error-free, or accurate, or that points or data will never be lost.
To the fullest extent the law allows, GNM and its owners, hosts, partners, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any injury, loss, or damage arising from your participation, including activity while handing out flyers. Our total liability for any claim related to the Service is limited to $100.
Some places don't allow certain limits, so some of these may not apply to you.
12. Indemnity
You agree to defend and hold harmless GNM and its owners, hosts, and partners from claims, fines, and costs (including reasonable attorneys' fees) that arise from your breaking these Terms or the law, Your Content, or how you handed out or posted flyers.
13. Governing law and disputes
Getaway LLC is a Florida limited liability company. These Terms, and any dispute about them or the Service, are governed by the laws of the State of Florida, without regard to conflict-of-law rules, no matter where you work. Any dispute will be handled only in the state or federal courts located in the State of Florida, and you agree to those courts' jurisdiction and venue. Before filing a claim, please email us so we can try to resolve it informally.
14. Changes to these terms
We may update these Terms. When we make important changes, we'll update the version date above and ask you to accept the new Terms in the Service before you keep using Drops. If you don't accept, you can stop using Drops and ask us to delete your account.
